Absolutely. I’d make this customer-friendly but protective—especially because balloons are perishable/custom products and because delivery/setup conditions can be outside your control.

TERMS OF SERVICE

These Terms of Service (“Terms”) apply to all purchases, orders, deliveries, pickups, installations, and services provided by Garden State Balloons (“Garden State Balloons,” “GSB,” “we,” “us,” or “our”). By placing an order, submitting payment, or accepting products or services from Garden State Balloons, the customer (“Customer” or “you”) agrees to these Terms.
1. ORDERS & PAYMENT
All orders are subject to availability and are not considered confirmed until payment has been received or otherwise approved by Garden State Balloons.
Custom orders, installations, large-volume orders, and special-order products may require full payment or a deposit before materials are purchased or production begins.
Prices are subject to change. Once an order has been confirmed and paid, the price for that order will not change unless the Customer requests modifications, additions, delivery changes, or other services.
2. CUSTOM & PERISHABLE PRODUCTS
Balloons are considered custom and perishable products. Many orders are prepared specifically for an individual Customer based on requested colors, quantities, personalization, event dates, themes, or designs.
Because of the custom and perishable nature of our products, all sales are final once production or preparation has begun.
Garden State Balloons does not guarantee an exact lifespan for any balloon product. Balloon longevity varies depending on balloon type, size, temperature, humidity, sunlight, transportation, handling, elevation, and environmental conditions.
3. CANCELLATIONS & REFUNDS
Cancellation requests must be submitted to Garden State Balloons as soon as possible.
Orders cancelled before production begins may be eligible for a refund, less any non-refundable materials, custom products, personalization, processing fees, or special-order items already purchased for the order.
Once balloons have been inflated, personalized, assembled, treated, or otherwise prepared for an order, the associated portion of the order is non-refundable.
Same-day and rush orders are non-refundable once accepted and production has begun.
For installations or larger custom orders requiring advance purchasing, staffing, or reserved production time, deposits and payments may be subject to separate cancellation terms provided with the Customer's proposal or invoice.
4. CHANGES TO AN ORDER
We will make reasonable efforts to accommodate changes requested before production begins.
Changes requested after materials have been purchased or production has begun may result in additional charges and are subject to availability.
Changes to delivery time, delivery location, installation requirements, quantities, colors, personalization, or design may also result in additional fees.
5. COLORS, DESIGNS & SUBSTITUTIONS
Balloon colors may appear differently in person than they do on a computer or mobile screen. Slight variations may also occur between balloon manufacturers, production batches, balloon sizes, and inflation levels.
We will make every reasonable effort to match requested colors and designs.
If a particular balloon, color, size, brand, or accessory becomes unavailable, Garden State Balloons reserves the right to make a reasonable substitution of similar style, quality, and value when necessary to complete the order.
For significant substitutions that materially change the overall design, we will attempt to contact the Customer before proceeding.
6. CUSTOMER-SUPPLIED BALLOONS
Garden State Balloons may offer helium inflation for balloons purchased elsewhere.
We cannot guarantee the quality, condition, age, construction, or performance of balloons supplied by the Customer or another retailer.
Garden State Balloons is not responsible for customer-supplied balloons that pop, tear, leak, have defective seams or valves, fail to float, or otherwise become damaged during or after inflation due to the balloon's material, manufacturing, age, condition, or another factor outside our control.
If a customer-supplied balloon cannot successfully be inflated, we are not responsible for replacing or reimbursing the cost of the balloon or the helium used to inflate.
7. HELIUM BALLOONS & FLOAT TIMES
Float times are estimates only and are not guaranteed.
Latex balloons generally have shorter float times than foil balloons. When appropriate, Garden State Balloons may use a balloon treatment such as Hi-Float to extend the expected float time of latex balloons.
Environmental conditions can substantially affect balloon performance. Heat, cold, direct sunlight, humidity, wind, air conditioning, heaters, vehicle temperatures, and other environmental factors can shorten balloon life or cause balloons to expand, contract, oxidize, deflate, or pop.
Customers should never leave balloons in a hot or cold vehicle.
8. PICKUP ORDERS
Customers are responsible for providing a vehicle large enough to safely transport their balloon order.
Garden State Balloons is not responsible for damage that occurs after an order has been picked up, including damage caused by improper transportation, insufficient vehicle space, sharp objects, excessive heat or cold, opening vehicle windows, or Customer handling.
We reserve the right to advise a Customer that an order cannot safely fit into a particular vehicle.
Once the Customer accepts and leaves with the order, responsibility for the balloons transfers to the Customer.
9. DELIVERY
Delivery windows are estimates and may be affected by traffic, weather, road closures, parking, building access, security procedures, or other circumstances outside our control.
The Customer is responsible for providing accurate delivery information and ensuring that someone is available to receive the order when required.
Additional charges may apply for excessive wait times, inaccessible delivery locations, parking fees, tolls, difficult loading conditions, stairs, extended carrying distances, or changes to the delivery location or time.
Once balloons have been successfully delivered and accepted, Garden State Balloons is not responsible for subsequent damage caused by guests, pets, children, venue staff, weather, environmental conditions, or improper handling.
10. INSTALLATIONS
The Customer is responsible for ensuring that Garden State Balloons has reasonable access to the installation location at the agreed-upon time.
The Customer must disclose relevant installation conditions in advance, including stairs, loading restrictions, security procedures, limited parking, venue rules, ceiling restrictions, wall restrictions, outdoor conditions, or other circumstances that may affect installation.
If the installation cannot be completed as originally planned because of undisclosed venue restrictions or site conditions, Garden State Balloons may modify the installation as reasonably necessary.
Additional labor or waiting time caused by circumstances outside Garden State Balloons' control may result in additional charges.
11. OUTDOOR BALLOON INSTALLATIONS
Outdoor balloon installations are particularly susceptible to weather and environmental conditions.
Heat, cold, rain, wind, direct sunlight, humidity, trees, landscaping, rough surfaces, and other outdoor conditions may cause balloons to oxidize, fade, shrink, expand, move, deflate, or pop.
Garden State Balloons does not guarantee the appearance or longevity of outdoor balloon installations once installation is complete.
If weather or site conditions create an unsafe situation for our team or make the requested installation impractical, Garden State Balloons reserves the right to modify, relocate, postpone, or discontinue the installation.
12. WEATHER & EVENTS BEYOND OUR CONTROL
Garden State Balloons is not responsible for delays, cancellations, damage, or inability to perform caused by circumstances reasonably outside our control, including severe weather, flooding, fire, power outages, road closures, accidents, government restrictions, venue closures, supply-chain interruptions, or other force majeure events.
When reasonably possible, we will work with the Customer to find an alternative solution.
13. RENTAL EQUIPMENT
Certain installations may include equipment belonging to Garden State Balloons, including stands, frames, bases, poles, weights, backdrops, or other reusable items.
Unless specifically purchased by the Customer, these items remain the property of Garden State Balloons.
Customers are responsible for protecting rental equipment while it is at the event location. Lost, stolen, damaged, or discarded equipment may be charged to the Customer at replacement cost.
Rental equipment may not be moved, dismantled, altered, or disposed of without permission from Garden State Balloons.
14. BALLOON SAFETY
Balloons are decorative products and are not toys.
Uninflated or broken balloons may present a choking hazard, particularly to young children. Children should be supervised around balloons, balloon accessories, ribbons, weights, and installation equipment.
Latex balloons may contain natural rubber latex and may cause allergic reactions in individuals with latex sensitivities.
Foil balloons conduct electricity and should never be released outdoors or placed near electrical lines.
Garden State Balloons does not intentionally release helium balloons outdoors and strongly discourages balloon releases.
Customers are responsible for the safe use and disposal of balloons after delivery or installation.
15. PHOTOGRAPHY & SOCIAL MEDIA
Garden State Balloons may photograph completed balloon arrangements and installations for portfolio, website, advertising, and social-media purposes.
We will make reasonable efforts not to prominently feature identifiable guests, particularly children, without appropriate permission.
Customers who do not want their event décor photographed or published should notify Garden State Balloons before the event or installation.
16. CUSTOMER SATISFACTION & ORDER ISSUES
If there is a problem with an order, please contact Garden State Balloons as soon as reasonably possible after receiving the order, preferably while the balloons are still in their original condition.
Photographs may be requested so that we can evaluate the issue.
Because balloons are perishable and can be affected by environmental conditions after pickup or delivery, Garden State Balloons may be unable to provide a replacement, refund, or credit for issues reported significantly after the order was received.
When Garden State Balloons determines that an order was materially incorrect or defective due to an error on our part, we may, at our discretion and as appropriate under applicable law, offer a replacement, correction, store credit, or refund for the affected portion of the order.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Garden State Balloons' liability relating to any order, product, delivery, installation, or service will not exceed the amount paid by the Customer for the portion of the order giving rise to the claim.
Garden State Balloons will not be responsible for indirect, incidental, consequential, or special damages arising from balloon failure, event changes, venue conditions, environmental conditions, Customer handling, or circumstances outside our reasonable control.
Nothing in these Terms is intended to waive or limit any right or remedy that cannot legally be waived or limited under applicable law.
18. WEBSITE & ONLINE ORDERS
Customers are responsible for reviewing all order information before submitting an online purchase, including product selection, quantities, colors, personalization, pickup or delivery information, event date, and contact information.
Submitting an order does not guarantee availability if inventory, delivery capacity, or production capacity becomes unexpectedly unavailable. If Garden State Balloons cannot fulfill an accepted order, we will contact the Customer regarding available alternatives or an appropriate refund.
19. INTELLECTUAL PROPERTY
Photographs, original designs, website content, branding, graphics, product descriptions, and other materials created by Garden State Balloons remain the intellectual property of Garden State Balloons unless otherwise stated.
Third-party character names, trademarks, and copyrighted designs remain the property of their respective owners. Garden State Balloons is not affiliated with or endorsed by those rights holders unless expressly stated.
20. GOVERNING LAW
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
Any dispute arising from an order or service provided by Garden State Balloons will be handled in accordance with applicable New Jersey law.
21. CHANGES TO THESE TERMS
Garden State Balloons reserves the right to update these Terms from time to time. The Terms in effect at the time an order is placed will generally apply to that order unless otherwise agreed in writing.
